Child Support
Child support is determined by guidelines provided by Wisconsin law. Administrative Rule DWD 40 provides guidelines to family courts for setting child support payment amounts. The guidelines are based on the premise that both parents are responsible for supporting their children.
Wisconsin's Department of Workforce Development provides a detailed explanation of how the guidelines work in particular circumstances.
Child support will vary depending on your particular circumstances, including gross income of the parties, percentage the child(ren) live with each parent, child care costs, ability to earn and other factors.
While the guidelines use mathematical formulas, like any other complex legal process, there is room for subjectivity. The ability and experience of your attorney can significantly affect the amount you will pay or receive in child support.
